Federal High Court Affirms Adron Homes’ Right to Manage Estate, Dismisses Residents’ Suit

The Federal High Court in Abeokuta, Ogun State, has ruled in favour of Adron Homes and Properties Limited, dismissing a suit filed by the Registered Trustees of the City of David Residents Association (CODRA) and five individuals against the property developer.

The case, numbered FHC/AB/FHR/58/2023, was heard by Hon. Justice Abiodun J. Adeyemi, who described the Applicants’ claims as “unsubstantiated, speculative, and without merit” after a detailed review of the evidence.

The Applicants — Elder Gbadebo Aromolaran, Mr. Adetokunbo Adeshile, Mr. Olaolu Ayinde, Olusegun Aba Yomi Esq, and Oluwadamilare Awokoya Esq — alleged that Adron Homes had infringed on their right to personal liberty. However, the court held they failed to provide credible proof that the company had posed any threat or committed any act constituting a breach of their fundamental human rights.

Justice Adeyemi stated there was “no record or proof of any invitation, arrest, or action traceable to Adron Homes” that could justify such allegations.

On the issue of proscription and infringement of the Applicants’ freedom of association, the court clarified that Adron Homes “has no power to proscribe CODRA or prevent residents from associating.” However, it emphasised that while residents are free to form associations, “the legal right to own, manage, and make administrative decisions concerning the estate remains vested in Adron Homes,” as the rightful developer and manager.

The judge stressed that the verdict was based strictly on “evidence and the law” rather than conjecture or personal interpretations. Consequently, the Applicants’ suit was dismissed in its entirety.

Following the ruling, Adron Homes reaffirmed its commitment to the welfare of its residents, stating that “the true victory is in ensuring the well-being and satisfaction of all subscribers and residents” and promising to “continue guaranteeing this.”

The judgement, seen as a landmark in estate management disputes, reinforces Adron Homes’ position as a law-abiding, customer-focused developer dedicated to protecting the interests of its clients.
